PodCensus website terms of use

These terms govern your use of podcensus.com and the PodCensus pre-launch waitlist. The website is operated by AI2Easy Pty Ltd (ABN 84 679 007 839), trading as AI2Easy (“PodCensus”, “we”, “us” or “our”).

By using the website, you agree to these terms. If you do not agree, please do not use the website.

1. About the pre-launch website

PodCensus is developing a research service for discovering and assessing Australian podcasts and potential guest opportunities.

The website currently provides product information, illustrative sample records and a waitlist. It does not currently provide access to the full commercial product.

2. Waitlist registration

You must provide accurate information when joining the waitlist and must not submit another person’s information without authority.

Joining the waitlist:

• records your interest in PodCensus
• allows us to send a short sequence of launch emails about launch timing, product access and the founder-rate offer
• does not create a paid subscription
• does not guarantee an invitation date, product access, feature availability or a particular price

Any founder-rate offer will be subject to the offer details and product terms supplied at launch. You may leave the waitlist or unsubscribe at any time.

3. Illustrative information

Sample show names, audience ranges, recency values and contact indicators on the pre-launch website may be illustrative. They should not be used as the basis for a campaign, financial decision or representation to a client.

Published coverage counts are snapshots and may change as records are discovered, checked, updated or retired.

4. No guarantee of outcomes

PodCensus is intended to support research. It does not guarantee:

• that information will always be complete, current or error-free
• that a contact route will deliver or receive a response
• that a podcast accepts guest pitches
• that a pitch will be accepted or an interview published
• audience size, reach, publicity, revenue or any other result

You remain responsible for checking information and deciding whether, how and when to contact a show.

5. Acceptable use

You must not:

• interfere with the operation or security of the website
• attempt to gain unauthorised access to systems or data
• introduce malware or harmful code
• use automated means to scrape, copy or extract website content except as permitted by law or with our written consent
• impersonate another person or misrepresent your authority
• use the website to infringe rights, breach privacy, send spam or engage in unlawful conduct

We may restrict access where reasonably necessary to protect the website, users, data or our legal interests.

6. Intellectual property

Unless otherwise stated, the website, PodCensus name and branding, design, original copy, compilation and software are owned by or licensed to us.

You may view and use the website for your own legitimate business evaluation. You may not reproduce, commercialise or create a competing dataset from protected website content without permission, except where permitted by law.

Third-party podcast names, brands and content remain the property of their respective owners. Their appearance does not imply endorsement or affiliation.

7. Third-party links

The website may link to third-party sites. We do not control their availability, content, security or practices. A link does not necessarily mean we endorse the third party.

8. Privacy

Our handling of personal information is described in the PodCensus Privacy Policy. The waitlist may also display a collection notice explaining the specific purpose of the information requested.

9. Availability and changes

We may change, suspend or discontinue any part of the pre-launch website or waitlist. We may also update these terms by publishing a revised version with a new effective date.

10. Liability and Australian Consumer Law

Nothing in these terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded, including rights that may apply under the Australian Consumer Law.

To the extent permitted by law, we are not responsible for indirect or consequential loss arising from reliance on pre-launch, illustrative or third-party information, or from events outside our reasonable control.

11. Governing law

These terms are governed by the laws of New South Wales, Australia. The parties submit to the courts with jurisdiction in New South Wales, subject to any rights that cannot lawfully be limited.
